India has taken the first step toward dispute settlement at the World Trade Organization by requesting consultations with the U.S. over eight state-level renewable energy programs that allegedly have domestic content requirements and contain subsidies in violation of WTO rules.

According to Geneva sources, India is specifically raising issues with renewable energy programs provided by the states of Washington, California, Montana, Massachusetts, Connecticut, Michigan, Delaware and Minnesota. The programs provided by those states violate the WTO Agreement on Trade-Related Investment Measures (TRIMS) and the Agreement on Subsidies and Countervailing Measures, Geneva sources said.
A spokesperson from the Office of the U.S. Trade Representative told Inside U.S. Trade that the office is reviewing the request and “will respond to India in due course.”
